TOPIC: Alienation of Income, PSI and Part IVA – Unpacking PCG 2024/D2

The draft Practical Compliance Guideline PCG 2024/D2 provides important guidance on the alienation of personal services income (PSI) and how Part IVA (anti-avoidance provisions) may apply to certain tax arrangements.

It clarifies how the ATO will assess whether income derived from personal services has been inappropriately diverted to lower-taxed entities or structures. By outlining the risk factors and compliance expectations, the PCG helps individuals and businesses understand how the alienation of income rules apply, reducing the risk of tax avoidance through improper income splitting or structuring.

Archana is a skilled tax lawyer with more than a decade of experience in assisting private clients with managing their tax affairs and unlocking value from their business / investment ventures. She has 13+ years of experience as a tax advisor assisting small-to-medium sized enterprises, high net worth individuals and family groups with interests in a wide range of sectors.

 

In addition to broad experience in tax advisory and disputes, Archana has niche expertise in the tax aspects of estate planning, the taxation of deceased estates and trust law. Her skills span Federal taxes (including income tax, CGT and GST), State taxes (including payroll tax, stamp duty and land tax) as well as the superannuation guarantee regime.

 

Archana holds a combined Bachelor of Laws/Bachelor of Commerce (Finance) degree from Monash University. She is an associate member (ATI) of the Tax Institute and full member (TEP) of the Society of Trust and Estate Practitioners (STEP). Archana is also a regular presenter at discussion groups held by CPA Australia.
