In September 2021 the Full Federal Court issued a judgement where a marital home in the name of the so called “risk free” spouse was successfully attacked by the ATO. The result, 50% of the home was available to the Commissioner for ATO debts due by the “at risk” husband

In this session Grant Abbott from Abbott & Mourly lawyers and Chairman of the Succession, Asset Protection and Estate Planning Advisers Association will look at the judgement and consider its impact on clients, how far it goes, when will the Commissioner strike and what to do now with clients that are impacted. Plus Grant will show a simple strategy that will put this case to bed.

In addition, as the author of five SMSF books for professionals Grant will also review his five top SMSF strategies for unlicensed accountants and consider ASIC exemptions on SMSF advice for accountants and tax agents.

Guest Speaker: Grant Abbott – Director | I Love SMSF

Grant Abbott is currently CEO of LightYear Docs and a specialist legal consultant to Abbott & Mourly Lawyer. Grant is currently Chairman of the recently formed Succession, Asset Protection and Estate Planning Advisers Association (SAPEPAA).

He was the research director of the Taxation Institute of Australia (“TIA”) following graduation and worked closely with Justice Graeme Hill, Professor Robert Deutsch of ATAX UNSW and Professor Graham Cooper of Melbourne University. He was also the youngest member of the NSW State Council of the TIA that consisted of leading lights in the taxation industry including Justice Richard Edmonds.

Other notable achievements include:

  • Development of the leading training course for advisers providing advice in self-managed super funds and recently succession, asset protection andestate planning;
  • Writing on super fund issues on behalf of many major financial services publications including the SMSF magazine, Money Management and being regularly quoted in BRW and the Financial Review;
  • Publishing a specialist SMSF journal with more than 100 editions;
  • Writing five books on SMSFs and currently writing one on succession, assetprotection, strategic structuring and estate planning; and
  • Making numerous submissions to Treasury and Government on various issues
